BVH Photograph/Video Policy
Conditions
Unless otherwise stated in the Buena Vista Heritage Museum (BVH)
Collections Use Agreement, purchase of photographs or otherwise obtaining
images or videos of or from the collections constitutes agreement to comply with
these conditions:
1) Permission is not necessary for personal use (i.e.
display in the home, personal gift, etc.) of an image or video. Use of the
image or video in any public manner, including publication, reproduction, or
display (i.e. publication, website, public display) requires written permission
from the BVH.
2) The user must secure copyright clearance from the
copyright holder and assumes responsibility for questions of copyright that may
arise. The granting of permission to
publish by the BVH does not absolve users of materials from securing permission
from copyright owners. In requesting permission to reproduce materials from the
BVH, the requester agrees to hold harmless the BVH and its officers and
employees from any action involving infringement of the rights of any person or
heirs and descendants in common law or under copyright law.
3) The BVH reserves the right to limit the number of
photographic copies; to restrict the use for reproduction of rare or valuable
material; to ensure that reproductions are in good taste and that use is
consistent with the mission of the BVH. Before publication, the BVH reserves
the right to require a proof for approval.
4) Images of items or copies of photographs in the
collections that will be used for any form of publication, reproduction, or
display must be obtained from the BVH or with the BVH's written permission.
5) Images may be cropped to suit design or layout, but
they may not be altered. Images may not be drawn upon or manipulated in any way
so that they look different from the way they appear in the historical
collection.
6) All reproduced photographs must be credited to the
Buena Vista Heritage Museum, followed by
the identifying negative or scan number (if available), and the name of the
artist or photographer, if known.

A complimentary copy of any publication or reproduction using BVH materials
(images, or transcripts from manuscript collections) must be sent to the BVH
within 3 months of the publication/air date.
8) Publication or reproduction of photographs or other
materials from the collections requires written permission from the BVH. Fees
are determined and subject to museum director. Permission is granted for
one-time use and for the number of copies specified on the agreement. Subsequent
printings or editions such as book-club, paperback, electronic format, or
international editions require further written permission and may require
payment of additional fees.
9) Requests for copies of graphic items intended for single
mass reproductions into formats such as poster, post cards, or note paper may
be subject to special contractual procedure.
10) In addition to processing fees, reproduction fees are
charged for the commercial use of images.
11) Images or videos to be published on web pages are to be
obtained from the BVH. Credit must appear on the screen with the image. User
must supply the Society with the exact web page address on which the images
will be displayed. Permission is for one time use only, that is, the image may only
be displayed for a specific time period on the specific web page designated on
the use agreement.
12) The BVH reserves the right to refuse to grant
permission. This includes the right to refuse to provide photo reproduction
services to publishers and individuals who have not complied with our policies.
** printed matter: it is
preferred that the credit line appear on the same or facing page as the
illustration or with "Sources of Illustrations." Each individual item
must be credited.
** films, video, and CD format use: credit with "Other
Sources of Illustrations."
** exhibitions: show credit
within the exhibition area.
**web site use: show credit
on the screen where the image appears. Each image must be identified
individually.
